Host Terms of Service

The contract between you and Strict Mode Ltd when you create a host account or buy an event plan.

This document is with our lawyers for final review. Still to be confirmed: the effective date.

The legal pages are published as one set, so every page carries this notice until the last detail is confirmed. Anything this page quotes that is still outstanding is marked below.

If you need any of it now, email hello@mosaikin.app and we will tell you.

These terms are a contract between you and Strict Mode Ltd, a company registered in England and Wales (company number 14561751, registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ), trading as Mosaikin (“we”, “us”). They apply when you create a host account or purchase an event plan. Separate short-form terms — the Guest Terms — apply to guests who contribute to your event without an account. The Acceptable Use Policy, Privacy Notice and Refund & Cancellation Policy form part of these terms.

Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

1. The service

Mosaikin lets you create a private event gallery. Your guests join by invite code or QR code — no app download or account — and can upload photos and sign a digital guestbook. You control who joins, what is published, and how long the event lasts, subject to these terms.

We supply the service with reasonable care and skill, and any digital content we supply will be of satisfactory quality, fit for purpose and as described.

2. Your account

  • You must be at least 18 and able to enter a contract.
  • Keep your login credentials and your event’s invite code confidential. The invite code admits anyone who holds it — share it only with people you want at your event.
  • You are responsible for activity under your account unless it results from our failure to keep the service secure.

3. Your role as host

You are the organiser of your event space:

  • You invite the guests. Distribute the invite code or QR only to your event’s attendees.
  • You moderate. We give you moderation tools (approval queues, hide, delete). Content our automated safety checks are unsure about is held for your review and never published without a decision. You can opt to review every contribution before it appears.
  • You must not approve, publish or retain content that breaches the Acceptable Use Policy. If you see content you believe is unlawful, report it (section 11) rather than simply deleting it.

4. Guests’ content and yours

  • Everyone keeps what they own. You and your guests retain all intellectual property in uploaded content. We claim no ownership.
  • Licence to us. You grant us (and each contributor grants us, via the Guest Terms) a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, reformat and display content solely to operate, provide, secure and improve the service — for example generating thumbnails, streaming the gallery, producing keepsakes you order, and running safety checks. This licence ends when the content is deleted (allowing a short period for backup cycles and any legal-preservation obligation).
  • We will never use your event’s content in marketing or any commercial material without separate, specific, written permission. Deleting content or your account withdraws any such permission for future use.
  • Licence to your guests. Content published to your event is visible to people with access to that event, according to your visibility settings.

5. Photos of other people

Event photos depict real people. By uploading or approving content you confirm you have the right to share it and, where it identifiably depicts someone else, that you reasonably believe they would not object. Anyone who appears in content on Mosaikin — whether or not they use the service — can ask us to remove it (see the Privacy Notice section 9 and the reporting route in section 11 below).

6. Plans, storage and retention

  • Plan features, quotas and prices are stated at purchase. The total price you see at checkout is the total you pay.
  • Free events are time-boxed: content is retained for the lifetime of the event plus a grace period of six months, after which it is permanently deleted. We will make export available before purge.
  • Paid keepsake events are retained until you delete them or close your account — permanence is the product.
  • Dormant accounts (no login for 24 months) receive notice before deletion.
  • We maintain backups, but you should download and keep your own copies of irreplaceable content; section 14 sets out our liability, which we do not exclude where loss is caused by our failure to exercise reasonable care and skill.

7. Payments, cancellation and refunds

Payments are processed by Stripe; we never see or store full card details. Your cancellation rights, the 14-day cooling-off mechanics, and our fair-refund promise are in the Refund & Cancellation Policy, which forms part of these terms.

Printed products. You can order printed items made from your event, such as beermats, from your event’s Keepsakes tab. These terms of sale apply to them:

  • Who sells, and when the contract is made. Strict Mode Ltd sells printed products to you; our print partner makes and posts them for us. The contract is made when we email you the order confirmation after your payment.
  • Price. The price of each item and the UK delivery charge are shown before you pay, and the total at checkout is everything you pay, including VAT where it applies.
  • Your design. We print the event details and the design you chose, including anything you entered such as a table number. Please check it before you pay: printed items are made exactly to your order.
  • Delivery. We deliver to UK addresses only, within 30 days of your order unless we agree a different date with you. We email you when your order is posted, with tracking where the carrier provides it.
  • Cancelling. Printed products are made to your specification and personalised for your event, so the 14-day right to cancel does not apply to them (Consumer Contracts Regulations 2013, regulation 28(1)(b)). You can still cancel for a full refund until we send your order to the printer: email hello@mosaikin.app with your order reference.
  • Faulty, damaged or lost items. If an item arrives faulty, damaged or not as described, or never arrives, email hello@mosaikin.app with your order reference (and a photo if it is damaged). We will reprint it or refund you. This does not affect your statutory rights under the Consumer Rights Act 2015.
  • Your delivery details. Stripe collects your delivery address and email at checkout. How we use them, who receives them and how long we keep them is in the Privacy Notice.

8. Acceptable use

The Acceptable Use Policy applies to you and to your guests. You must not attempt to probe, disrupt or reverse-engineer the service, misuse invite codes, or automate access without permission.

9. Content safety — what we do

So that these terms say plainly how people are protected from illegal content:

  • Every uploaded photo and guestbook entry passes an automated safety check before it can appear publicly. Content the system is unsure about is held for host review; content assessed as illegal or seriously harmful is blocked, is never published, and is preserved and reported where the law requires (section 10).
  • If a safety check cannot run, content is held for review rather than published — the system fails closed.
  • Terrorism content is dealt with as the law requires of it separately: it is blocked or taken down as soon as we become aware of it, by the automated check or a report, it is never published, and the evidence is preserved and referred to the authorities. Child sexual exploitation and abuse content is section 10; every other kind of illegal content is handled under the Acceptable Use Policy and this section.
  • We use automated (including third-party) detection technology for this purpose. We do not use facial recognition and do not build biometric profiles.

10. Child sexual abuse material

We operate a zero-tolerance policy. We report detected child sexual exploitation and abuse content to the National Crime Agency as UK law requires, including preserving associated evidence for the legally mandated periods. See the Safety page. Uploading such material will result in immediate blocking, account termination and referral to law enforcement.

11. Reporting content

Anyone — a host, a guest, or a person who does not use Mosaikin but is affected by content on it — can report content they believe is illegal or breaches the Acceptable Use Policy:

  • using the Report control on any photo or guestbook entry — no account needed; or
  • by email to safety@mosaikin.app, including a link to or a description of the content.

We review reports promptly, prioritising illegal-content reports, and take proportionate action including removal, blocking and referral to authorities. We will tell you the outcome of your report unless the law prevents it.

12. Complaints and appeals

If you believe we removed your content or restricted your account wrongly, or that we have failed to comply with our safety duties, you can complain to safety@mosaikin.app or through the support page. We acknowledge complaints promptly, investigate, and respond with reasons. If you are dissatisfied you may escalate to us for a second review by someone not involved in the original decision. This procedure is free, and using it does not affect your right to go to court.

13. Suspension and termination

  • By you: close your account at any time; deletion follows the Privacy Notice’s erasure process.
  • By us: we may suspend or terminate accounts that materially or repeatedly breach these terms or the Acceptable Use Policy, or where the law requires. Except where the breach is serious (illegal content, safety risk, fraud), we will warn you and give you a chance to fix the problem first, and we will give you the reasons and a route of appeal (section 12).
  • Termination does not affect refund rights that have already accrued.

14. Our liability

  • Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law — including your statutory remedies under the Consumer Rights Act 2015 (repeat performance or price reduction where a service is not performed with reasonable care and skill; repair, replacement or refund for defective digital content; and compensation where digital content we supply damages your device or other digital content and we failed to use reasonable care and skill).
  • We are not liable for losses that were not foreseeable to both of us when the contract was made, for content uploaded by you or your guests (subject to our safety duties), or for events genuinely outside our reasonable control.
  • Subject to the above, our total liability to you is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.
  • The service is for private, non-business use; we are not liable to you for loss of profit or business.

15. Changes to the service or these terms

We may improve or change the service. If we make a change to these terms that is to your material disadvantage, we will give you reasonable advance notice by email and you may end the contract and receive a pro-rata refund of any unused paid period before the change takes effect. The terms version applying to a purchase is the one in force at the time of purchase.

16. General

  • These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
  • If any clause is found unenforceable, the rest stand.
  • You may not transfer your account; we may transfer our rights to a successor business that will honour these terms.
  • Complaints about how we handle personal data can also go to the Information Commissioner’s Office (see Privacy Notice section 11).
